1. Agreement to These Terms
By creating an account or using OpsHound, you agree to these Terms of Service ("Terms"). These Terms form a legally binding agreement between you (or the organisation you represent) and Kixo Limited trading as OpsHound, a company registered in Ireland ("OpsHound", "we", "us").
If you are using OpsHound on behalf of an organisation, you confirm that you have authority to bind that organisation to these Terms.
2. What OpsHound Does
OpsHound is a SaaS platform that enables businesses to automate browser-based workflows using AI. You record a process, OpsHound generates an automation script, and that script runs on your behalf on a schedule or on demand.
3. Your Account
You are responsible for:
- Providing accurate information when registering
- Keeping your login credentials secure
- All activity that occurs under your account
- Ensuring anyone in your organisation who uses OpsHound complies with these Terms
You must be at least 18 years old to use OpsHound. Accounts are for business use.
4. Acceptable Use
You may use OpsHound only for lawful purposes and in accordance with these Terms. You agree not to use OpsHound to:
- Access systems, accounts, or data without authorisation from the owner of those systems
- Automate any activity that is illegal under applicable law
- Resell, sublicense, or white-label OpsHound or any part of it to third parties
- Circumvent, disable, or interfere with security features of the platform
- Transmit malware, viruses, or any malicious code
- Violate the terms of service of any third-party website or system you automate against
- Harass, harm, or defraud any person or organisation
We reserve the right to suspend or terminate accounts that violate these terms, with or without notice depending on the severity of the breach.
5. Your Content and Data
You retain ownership of all data, files, recordings, and outputs you create through OpsHound ("Your Content"). By using the platform, you grant OpsHound a limited licence to store, process, and execute against Your Content solely for the purpose of delivering the service to you.
You are solely responsible for ensuring that Your Content and your use of OpsHound complies with applicable laws, including data protection laws. If you are automating processes that involve personal data, you are responsible for having the appropriate legal basis to do so.
We do not use Your Content to train AI models.
6. Subscription and Payment
OpsHound is offered on a subscription basis, available on monthly or annual billing cycles. By subscribing, you authorise us to charge your payment method on a recurring basis at the rate applicable to your chosen plan.
- Monthly subscriptions renew automatically every month
- Annual subscriptions renew automatically every year
- You will be notified before any price changes take effect
- All fees are quoted exclusive of VAT where applicable
Payments are processed by Stripe. By subscribing, you also agree to Stripe's terms of service.
7. Cancellation and Access
You may cancel your subscription at any time through your account settings or by contacting us.
On cancellation or non-payment:
- Access to OpsHound is removed immediately
- Scheduled automations will stop running immediately
- Your data will be retained for 30 days following cancellation, after which it may be permanently deleted
- No refunds are issued for unused portions of a billing period, except where required by law
If your payment fails, we will attempt to notify you and may provide a short grace period before suspending access.
8. Free Trials
Where we offer a free trial, access is granted for the stated trial period with no charge. At the end of the trial, you will need to subscribe to continue using the platform. We reserve the right to modify or withdraw free trial offers at any time.
9. Intellectual Property
OpsHound, including its software, design, and documentation, is owned by Kixo Limited and protected by intellectual property law. These Terms do not grant you any rights to our intellectual property beyond the limited right to use the platform as described here.
Automation scripts generated by OpsHound on your behalf, using your recorded processes and instructions, are yours to use for your own business purposes.
10. Availability and Uptime
We aim to provide a reliable service but do not guarantee uninterrupted availability. We may carry out maintenance, updates, or emergency fixes that temporarily affect access. We will provide reasonable notice of planned downtime where possible.
11. Limitation of Liability
To the maximum extent permitted by applicable law:
- OpsHound is provided "as is" without warranties of any kind
- We are not liable for any indirect, incidental, or consequential losses arising from your use of the platform
- Our total liability to you in any 12-month period shall not exceed the total fees you paid to us in that period
Nothing in these Terms limits liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be excluded under Irish or EU law.
12. Indemnity
You agree to indemnify and hold OpsHound harmless from any claims, losses, or damages arising from your use of the platform in violation of these Terms or applicable law.
13. Third-Party Services
OpsHound integrates with third-party services including Supabase, Browserbase, Anthropic, Digital Ocean, Stripe, and Resend. We are not responsible for the availability, accuracy, or conduct of these services. Your use of OpsHound may be subject to those providers' own terms.
14. Changes to the Service
We may update, modify, or discontinue features of OpsHound at any time. We will give reasonable notice of material changes. Continued use of the platform after notice of changes constitutes acceptance of those changes.
15. Changes to These Terms
We may update these Terms from time to time. We will notify you of significant changes by email or in-app notice. The updated Terms will apply from the date stated at the top of this page.
16. Governing Law and Disputes
These Terms are governed by the laws of Ireland. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the Irish courts.
If you are a consumer based in the EU, you may also have rights under the laws of your country of residence that cannot be waived by this clause.
